Newsletter Terms

These Terms govern the free newsletter service provided by Space Ads sp. z o.o. They are framed under Polish law (which incorporates the EU electronic-services regulation) and the EU General Data Protection Regulation (GDPR).

§ 1. General provisions

1.1

The newsletter service is provided by Space Ads sp. z o. o., with registered office at Plac Bankowy 2, 00-095 Warsaw, Poland (KRS: 0001011955, VAT ID: PL 5252938464, share capital: PLN 10,000), referred to as the "Provider".

1.2

The newsletter is a free service rendered electronically. It consists in sending marketing email messages to the address provided by the User.

1.3

Use of the newsletter requires acceptance of these Terms and consent to the processing of personal data for marketing purposes (GDPR Art. 6(1)(a)).

§ 2. Scope of service

2.1 — Content

The newsletter contains, in particular:

a.

expert articles and digital advertising market analysis (Google Ads, Meta Ads, TikTok Ads);

b.

case studies of the Provider's clients;

c.

invitations to webinars and events organised by the Provider;

d.

information about the Provider's services and commercial offer.

2.2 — Frequency

Marketing newsletter messages are sent no more than 4 times per week. This cap covers marketing newsletter emails only — it does not apply to transactional emails (e.g. registration confirmations, links to materials the User signed up for separately), the welcome sequence triggered by signup, or reminders for events the User opted into separately.

2.3 — Form

Messages are sent from growth@space-ads.agency as email with HTML body and a plain-text alternative. Every message contains a one-click unsubscribe link in the footer (RFC 8058 compliant).

2.4 — Free of charge

The newsletter service is provided free of charge.

§ 3. Technical requirements

3.1

To use the newsletter, the User needs:

a.

an active email account;

b.

an email client or browser that renders HTML messages;

c.

internet access sufficient to receive email.

3.2 — Risks

The Provider notes that using a service rendered electronically carries the risks typical for the Internet (malware, phishing emails). The Provider follows email-authentication best practices (SPF, DKIM, DMARC, TLS) and will never request passwords or payment-card data via email.

§ 4. Subscription and termination

4.1 — Sign-up (double opt-in)

The agreement to provide the newsletter service is concluded by the User submitting their email address via the sign-up form on the Provider's website and confirming the subscription by clicking the confirmation link sent to that address. The confirmation link is valid for 7 days.

If the User submits the form but does not confirm their address within 24 hours, the Provider may send a single reminder to finish the sign-up. The reminder is transactional in nature — it contains no commercial content and serves solely to complete the process initiated by the User (Art. 6(1)(b) GDPR). Failure to confirm within the period set out in section 4.4 results in the User's data being automatically deleted.

4.2 — Sign-up via webinar registration

The User may also subscribe by checking the dedicated checkbox on the webinar registration form. In that case, subscription confirmation occurs together with the webinar opt-in (by clicking the webinar confirmation link). This requires the User's explicit, separate consent expressed by ticking the checkbox.

4.3 — Unsubscribe

The User may withdraw from the newsletter at any time, free of charge and without giving a reason, by:

a.

clicking the "Unsubscribe" link in the footer of any newsletter message (one-click unsubscribe per RFC 8058);

b.

sending a request to growth@space-ads.agency.

The unsubscribe takes effect at the moment it is submitted. The Provider stops sending newsletter messages without undue delay, and in any event within 72 hours.

4.4 — Confirmation expiry

If the User does not confirm subscription (does not click the confirmation link) within 7 days of signing up, the agreement is not concluded and the User's data is automatically deleted.

§ 5. Complaints

5.1

Complaints regarding the newsletter service should be sent to growth@space-ads.agency or in writing to the Provider's registered office.

5.2

A complaint should include the email address it concerns, a description of the issue, and the expected resolution.

5.3

The Provider will respond to complaints within 14 days of receipt, by email to the address provided by the complainant.

§ 6. Personal data

6.1 — Controller

The data controller is the Provider (§ 1.1).

6.2 — Purpose and legal basis

Personal data (email address, optionally name, IP address, sign-up and confirmation timestamps, preferred language) is processed to provide the newsletter service on the basis of the User's consent (GDPR Art. 6(1)(a)).

Because the Provider is established in Poland, sending the newsletter is additionally governed by the Polish Act on Providing Services by Electronic Means (Art. 10(2) — commercial information by electronic means) and the Polish Telecommunications Act (Art. 172(1) — direct marketing through electronic communication channels). The User's consent given on signup covers all three legal bases.

6.3 — Withdrawing consent

The User may withdraw consent at any time (equivalent to unsubscribing — § 4.3). Withdrawal of consent does not affect the lawfulness of processing based on consent before its withdrawal.

6.4 — Retention

Data is retained until consent is withdrawn. After withdrawal, the Provider keeps proof of consent and withdrawal (IP address, timestamps, source URL) for 3 years for accountability purposes (GDPR Art. 5(2)).

6.5 — Full information

Full information on data processing, the User's rights (access, rectification, erasure, restriction, objection, portability) and recipients of the data is available in the Privacy Policy.

6.6 — Right to lodge a complaint

The User has the right to lodge a complaint with a supervisory authority, in particular in the Member State of their habitual residence, place of work or place of the alleged infringement. In Poland the supervisory authority is the President of the Personal Data Protection Office (UODO, ul. Stawki 2, 00-193 Warsaw).

§ 7. Final provisions

7.1 — Governing law

Matters not regulated by these Terms are governed by Polish law, in particular the Polish Civil Code, the Act on Providing Services by Electronic Means, GDPR and the Polish Personal Data Protection Act.

7.2 — Changes

The Provider reserves the right to amend these Terms. Subscribers will be notified by email of any material change at least 14 days in advance. Refusing the new version of the Terms is treated as unsubscribing.

7.3 — Effective date

These Terms enter into force on May 7, 2026.
